CONSTITUTION

ARTICLE I: NAME AND AFFILIATION

NAME. The name of this nonprofit organization shall be the Ohio Association Teachers of Family and Consumer Sciences (OATFACS), which is a constituent organization within the Ohio Association for Career and Technical Education. The bylaws of this association shall be consistent with the Constitution and Bylaws of the Ohio Association for Career and Technical Education and the Association for Career and Technical Education. The Ohio Association Teachers of Family and Consumer Sciences referred to hereafter as the Association.

ARTICLE II: PURPOSES

Section I. The Association shall affirm and support the purposes of the Ohio Association for Career and Technical Education and the Association for Career and Technical Education Bylaws shall be recognized by the Association.

 Section II. The Association shall stimulate professional interest and participation in family & consumer sciences and shall support professional growth of all family & consumer science educators.

 Section III. The Association shall develop and support a communicative network among family & consumer sciences teachers and those career and technical education professionals supporting family & consumer sciences.

ARTICLE III: MEMBERSHIP

Section I. CLASSES OF MEMBERSHIP. The classes of membership as described in the Ohio Association for Career and Technical Education Bylaws shall be recognized by the Association.

 Section II. MEMBERSHIP ELIGIBILITY AND LIMITATIONS. Membership shall be available to all persons interested in the purposes of the Association regardless of race, creed, national origin or sex.

 Section III. PROPERTY AND INTEREST OF MEMBERS. All right, title and interest, both legal and equitable, of a member in and to the property of the Association shall end upon termination of an individual’s membership.

ARTICLE IV: AUTHORITIES AND GOVERNANCE

GOVERNANCE. The Association shall be governed by the Ohio Association for Career and Technical Education Constitution and Bylaws and by this document and the Executive Board of this Association. 

ARTICLE V: EXECUTIVE BOARD

Section I. The Executive Board shall constitute the governing body of the Association and its duties shall consist of those set forth in the bylaws.

 Section II. All Executive Board members must be affiliated members.

 Section III. The Executive Board shall consist of the immediate past president, elected officers, a state department advisor, and representatives at-large.

 Section IV. Liaison members shall be included on the Executive Board as non-voting members. The members shall include, but not be limited to, members representing family & consumer sciences teachers, family & consumer sciences supervisors, family and consumer sciences teacher educators, and those career and technical education professionals supporting family and consumer sciences.

ARTICLE VI: DELEGATES

The Association shall be represented at the Ohio Association for Career and Technical Education Delegate Assembly and at the Association for Career and Technical Education Assembly of Delegates when each convenes. 

ARTICLE VII: AMENDMENTS OF THE CONSTITUTION AND/OR BYLAWS

Section I. PROPOSAL. Amendments to the Constitution and/or the Bylaws may be proposed to the Constitution and Bylaws Committee by one or more of the following:

 1. by a majority vote of the Executive Board of the Association

 2. by petition signed by at least thirty (30) members of the Association

 Section II. AMENDMENT OF THE CONSTITUTION.

 A. A proposed amendment to the Constitution shall be presented in writing by the Constitution and Bylaws Committee to the Executive Board of the Association at least fifteen (15) days prior to consideration.

 B. Upon approval of Executive Board, the text of the proposed amendment(s) shall be made available to members at least thirty (30)days prior to their consideration.

 C. The Constitution may then be amended by a majority vote of the members present at the Annual Business Meeting.

 Section III. AMENDMENT OF THE BYLAWS.

 A. A proposed amendment to the Bylaws shall be presented in writing by the Constitution and Bylaws Committee to the Executive Board of the Association at least fifteen (15) days prior to consideration.

 B. Upon approval of the Executive Board, the text of the proposed amendment(s) shall be made available to members at least thirty (30) days prior to its consideration.

 C. The Bylaws may then be amended by a majority vote of the members present at the Annual Business Meeting.

 Section IV. VOTING ON AMENDMENTS.

 A.  Affiliated members are eligible to vote on proposed amendments.

 B. Voting on proposed amendments to the Constitution and/or Bylaws will follow procedures determined by the Executive Board.

 C. Unless otherwise provided, all amendments shall take effect at the beginning of the Association’s fiscal year following their adoption.

ARTICLE VIII: PARLIAMENTARY AUTHORITY

Robert’s Rules of Order (Newly Revised) shall be the authority on parliamentary procedure at any meeting of the duly constituted bodies of the Association. 

ARTICLE XI: PROVISIONS FOR THE DISTRIBUTION OF ASSETS

The Association intends that the assets of this organization be permanently dedicated to exempt purposes.  Should the Association dissolve, its assets are to be distributed to the Ohio FCCLA Endowment for Scholarships.  No property or assets of the Association shall inure to the individual members or otherwise of the association as a result of dissolution of the Association.
